By registering with this site, you accept the terms and conditions of use of Homeforswap.com. These terms and conditions of use constitute the entire agreement between you and Homeforswap.com. This website may assign its rights to this agreement without the member’s consent. Homeforswap.com will give notice to the membership the entity is sold to another entity or enters in an agreement with another company to share their listings.
If you do not agree with all of the terms of this Agreement, you may not access or use any part of this service.
- Homeforswap.com services are available only to persons who can form legally binding contracts under applicable law. Our services are not available under the age of 21, or age of majority in your jurisdiction of residence.
- Homeforswap.com is an introduction website. Accordingly, neither Homeforswap LLC nor its representatives offer any guarantee and make no warranty that the swapper will find an exchange with a compatible swapper partner, and that a home swap will result.
- It is not possible for Homeforswap.com or its representatives to inspect the house of the swappers registered. Accordingly, neither Homeforswap LLC nor its representatives accept any responsibility or liability for the quality, fitness for purpose or state of the swapper partner’s home, nor can Homeforswap LLC or its representatives accept any liability for any damage, accident or injury which might occur to the swapper or any member of his family, or any person accompanying the swapper to the swapper partner’s home, or to whom the swapper allows access whether as visitor tradesman or otherwise.
- Homeforswap.com is only responsible for publishing listings and relies on the integrity and responsibility of the listing. Homeforswap.com does not verify the existence or content of any property and does not guarantee an exchange of any kind. Homeforswap.com is not responsible for the actions of members, and claims no responsibility for the accuracy, content, or availability of information accessed or linked to through use of this service. All the users of Homeforswap.com take sole responsibility for all agreements reached through use of this site.
- The purpose of this website is to offer a structure for members to contact other members of homeforswap.com in order to arrange a home exchange. The information of each property and the email of each member will exclusively be shared with other members of homeforswap.com. The information contained herein is private and will not be shared in the public domain.
- Do not attempt to place any kind of commercial ad on this site; any member using this site for other purposes than exchanging a home will be removed immediately.
- Trading of any kind of products (i.e. firearms, tobacco, alcohol) is not permitted, as well as listings containing links to adult sites or affiliate ads.
- Homeforswap.com reserves the right to revoke any membership at anytime for violation of these terms and conditions of use.
- Members may not disclose or share their password to any third parties or use their password for any unauthorized purpose. Members are responsible for anonym zing their email and their password.
- Members may describe their home accurately and may not provide false or misleading information to Homeforswap.com and its members. And shall contact with courtesy and respect other members.
- Members will leave their home in a clean and sanitary condition for the swapper, and will notify the swapper of any damage caused.
- Members will treat the swapper’s home and belongings as they would treat their own, with respect.
- By posting photos, members allow Homeforswap.com to use them as an example of listing.
- Members should notify the swapper of any changes of dates, or any last minute changes
- Members may terminate their membership at any time by contacting sales@homeforswap.com, we require 1-month notice of cancellation. Refunds will not be given when members terminate their membership even if it remains time of membership.
- Members shall not upload, post or otherwise make available any material protected by copyright, trademark or other proprietary right without the permission of the owner.
- Homeforswap.com reserves the right to remove, at its discretion, any member who would not respect the terms of use, deleting his account, his listing(s) with no refund.
- The membership is a NON-refundable service. The fee you agree to pay to homeforswap.com (1 year, 2 years or 3 years membership) is a non-refundable fee.
- Indemnification: You agree to indemnify and hold harmless Homeforswap.com, or its representatives, from any injury or damage suffered directly or indirectly as a result of your use of the Homeforswap.com home listing service, including but not limited to any claims for injury or damage to person or property arising from a property you own; any claims for injury or damage to person or property arising from a property transaction to which you are a party; a violation of the Terms and Conditions of Use by you or anyone using your computer (or account, where applicable); a claim that any use of the Service by you or someone using your computer (or account, where applicable) infringes any property right of any third party; any misrepresentation by you; or any breach of any agreement to be performed by you. You agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable legal fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim.
- Copyright: The website contains copyright material, trademarks and other proprietary information including but not limited to text, photos, videos, software and the entire contents of this website are copyrighted under the United States copyright laws. Subscriber may not modify, publish, transmit, participate in the transfer or sale, or in any way exploit any of the content in whole or in part.
- Responsibilities: the Use of the Homeforswap.com web site and any information obtained from that site is at your sole risk. If Homeforswap LLC is unable to provide the promised level of service for any reason, including, but not limited to, negligence, service outrages, acts of God, neither Homeforswap LLC, nor its employees or any individual associated with the LLC can be held liable for any costs beyond the actual cost paid by the client for the services. Neither Homeforswap LLC nor any of its affiliates will be liable for any compensatory, direct, indirect, special, incidental or consequential damages, loss of data, income or profit, loss of or damage to property, or any claims of third parties arising from use of the website, regardless of the legal theory on which the claim is based, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of this information. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages. In no event shall Homeforswap.com be liable for any amount in excess of the membership fees paid by the member.
Any violation of these terms and conditions shall subject the violator to severe penalties. |
